These General Conditions of use and sale, are a translation of the French regulation, which applies in its French version and not in its interpretation in another language. This translation is to facilitate the understanding of our conditions but which remain under the French regulation.
General Terms and Conditions of Use and Sale
1. General Conditions of Use
GLOBAL YOUTH & STUDENT COMMUNITY (GYSC), a limited liability company with a capital of 100,000 euros, registered with the PARIS Trade and Companies Registry under number 493.503.841, whose registered office is located at 9 rue René Goscinny - 75013 Paris.
GYSC is the exclusive representative of the ISIC association for the territory of France in charge of issuing the ISIC card (ITIC and IYTC), of proposing programs of services and reductions and of publishing websites and smartphone application to make them known and use them.
By using the cards issued by GYSC, by registering or by using the websites and mobile applications of GYSC, the User declares to have read and accepted without reserve the current version of these GTC.
ISIC, ISIC France, ITIC, IYTC are protected trademarks of the company GYSC.
The terms mentioned below have the following meaning in the present GTU:
- « User »: any natural person in possession of a valid ISIC card (ITIC, IYTC) or who has applied for an ISIC card, using the isic.fr website and/or the ISIC France application
- « Publisher », « Company », « GYSC » refers to GLOBAL YOUTH & STUDENT COMMUNITY, the company that issues the ISIC card on French territory and publishes the website www.isic.fr and the ISIC France application
- « Site » : Internet site developed and operated by GYSC, one of whose URLs is the following: www.isic.fr
- « ISIC France » or « Application » : means the mobile application edited by GYSC available on the Play Store and the App Store
- « ISIC Card » : The ISIC (International Student Identity Card) is an international student card whose status is recognized by UNESCO. This card allows its holders to access advantages and discounts in France and abroad. ITIC (International Teacher Identity Card), IYTC (International Youth Travel Card).
- Content or program ISIC, ITIC, IYTC, 2enjoy..." : reductions, images, data, databases, software, offers, text, videos, hyperlinks, logos, and all elements present on ISIC, ITIC, IYTC, 2enjoy, ... Websites and ISIC Apps (ITIC, IYTC, 2enjoy).
The website www.isic.fr and the mobile application ISIC France list all the advantages and discounts intended for ISIC cardholders. Any Internet user can browse the Site or the Application freely. However, in order to benefit from these discounts (promotional codes, ticketing, etc.), it is necessary to create an account or to identify oneself on the Site or the Application and to be an ISIC card holder.
When creating an account, the User will be asked to provide the following precise and accurate information First Name/Last Name, ISIC Card Number, School, Date of Birth, E-mail, Password, Phone.
If the user does not yet have an ISIC card, he/she can order an ISIC card on the website www.isic.fr. To do so, he/she must provide the following information: First name/ Last name, School, Date of birth, E-mail, Telephone, Gender, Passport photo, School certificate. He/she must also pay the requested amount by credit card.
The data provided by the student is only used to verify and validate his/her profile and to allow him/her to access all ISIC discounts. Under no circumstances are these data transmitted to third parties.
The User's bank details are not kept by the Editor.
The User's registration is made for an indefinite period. At any time, the User who no longer wishes to benefit from the services offered by ISIC may request the termination of his account. This will be done by simply unsubscribing on the ISIC website or via the mobile application used. The data of the User's account will then be erased except for those necessary for the accounting and fiscal obligations incumbent on GYSC described in the General Conditions of Sale below.
The allocation of an ISIC card to a holder is individual. It is subject to verification of full-time student status during the current academic year, provision of a passport photograph and, in the case of an online ISIC card order, payment of the requested amount.
The services provided by ISIC are made available to Users for strictly personal use. It is forbidden to distribute or use these services to sell products or services, to increase the traffic of a third party website, for commercial reasons (sales, promotion, advertising, etc.), or for personal profit.
When creating an account or ordering an ISIC card, the User agrees to provide accurate information, including date of birth, last name, first name, school, photo ID and school certificate. Any false or inaccurate declaration and/or omission may engage his civil liability and expose him to penal sanctions (in application of article 441-7 of the Penal Code which punishes the establishment of a certificate stating materially inaccurate facts). "15,000 fine for drawing up a certificate stating materially inaccurate facts". In the event that the information provided by the User proves to be false or outdated, GYSC reserves the right to suspend or close the User's ISIC account and cancel the User's ISIC card without notice or refund.
User shall not use ISIC content in any way by reuse and display, or reproduce ISIC pages on any third-party website. If the User wishes to incorporate or reproduce content from the ISIC Site on another website, the User should contact ISIC by e-mail at firstname.lastname@example.org.
1-5-Responsibility of GYSC on the contents
GYSC endeavors to ensure to the best of its ability that the information accessible via the Site and the Application is accurate and up to date. Despite the care taken in the processing of information, the Company declines any responsibility concerning the errors or omissions concerning the information disseminated on its sites. GYSC accepts no responsibility for the accuracy, content, completeness, legitimacy, reliability, operability or availability of the information or data displayed by the ISIC site. GYSC accepts no responsibility for the deletion, alteration, failure to store, improper transmission, or untimely transmission of such information or data concerning student benefits. GYSC accepts no responsibility for damages that may result from the display of certain content that is not negotiated and implemented directly for ISIC, but lists a general student offer to which the User has access with his/her valid ISIC card. The conditions of use are then to be checked on the website of the brand mentioned. This offer is subject to cancellation or modification without prior notice from the cited company.
GYSC can receive requests on behalf of people who wish, to comment, to amend, to modify or even to remove certain functionalities or certain contents or certain links referenced on the Site and the Application ISIC France. GYSC reserves the right to treat these requests on a case by case basis. For any comment relating to the content, links or features, please contact us at email@example.com
We are committed to protecting and respecting your privacy in accordance with applicable privacy legislation, including Law No. 78-17 of January 6, 1978, as amended by the Law of August 6, 2004, Informatique et Libertés, and Regulation (EU) 2016/679 of April 27, 2016 (the "RGPD") on the protection of individuals with regard to the processing of personal data. CNIL declaration numbers 1288951 and 1826770.
1-7-Personal data processed
The personal data collected and processed by GYSC are the following: last name, first name, date of birth, e-mail, phone number, gender, photo ID, school certificate, order history, when applicable. For a purchase of an ISIC card, any other card, ticketing, gift cards or any other available product, we also ask you to provide us with a mailing address for shipping and billing purposes.
1-8-Why and how do we collect your personal data?
GYSC processes personal information for the purposes mentioned below:
The provision and activation of an ISIC card, an ITIC card or any other card implemented by GYSC
The access and the supply of products and services delivered by GYSC to the users
Subject to your consent: to send you information about our offers and news (newsletters, contests)
This Data is collected either based on your consent or is necessary for the execution of your orders (performance of a contract). This may include information you provide when you register to use the Site or the Application, fill out a form, correspond with us, make an ISIC card or ticket purchase, use discounts or subscribe to our newsletter.
We may also collect personal data about you from third parties such as educational institutions or partner banks that provide the ISIC card to their students or customers. This may be combined with other information you provide to us, as described above. Each ISIC partner institution and bank is responsible for providing notice to its cardholders about the purposes for which it collects personal data and how that personal data is processed.
1-9-Whose personal data are transmitted to?
Your Data are processed by GYSC. They will not be transferred or made accessible to any third party except for possible subcontractors for exclusively technical and logistical reasons (international ISIC database, hosting and maintenance service providers of the Site, payment service providers, emailing service providers, etc.).
In accordance with the regulations in force, you have the right to access and rectify your Data, as well as the right to request its deletion, to object to its processing and to obtain its limitation or portability insofar as this is applicable. The User has the option of refusing to provide us with personal information altogether, in which case GYSC may not be able to provide certain services, including the provision of the ISIC card.
These rights may be exercised directly with ISIC by emailing firstname.lastname@example.org. You may be asked to provide proof of identity.
In addition, you may at any time request to no longer receive communications from us regarding our offers, news and events by using the hypertext link provided for this purpose in each email we send you.
1-11-Personal data retention period
The ISIC card is valid from September 1 of one year to December 31 of the following year.
GYSC keeps the data necessary for the issuance of an ISIC card for 2 years after the end of the card's validity. This data will then be automatically deleted.
A user can request the deletion of his personal data during the validity of his card. This will prevent him/her from using his/her ISIC card digitally and only upon direct presentation.
In accordance with Article L. 123-22 paragraph 2 of the French Commercial Code, data and invoices concerning a purchase made by users on the Site or the Application will be kept for 10 years and then deleted.
1-12-Applicable law and conflict resolution
The present GTU are subject to French law. Any complaint concerning the interpretation, the conclusion and the execution of the present GCU must be addressed to the Editor at the address of its head office or by electronic way at the following address: email@example.com.
The User is informed that he can in any case resort to a conventional mediation, in particular with the Commission of the mediation of consumption (Code of Consumption art. L 534-7) or with the existing authorities of sectorial mediation, or with any alternative mode of settlement of the disputes (conciliation, for example) in the event of dispute.
2-GENERAL CONDITIONS OF SALE
The present general terms and conditions of sale (hereinafter "GTC") apply, in their version in force at the time of the order, to all orders placed by any natural person (hereinafter "you" or "the customer") via the websites and smartphone applications (hereinafter "the Site"), such as the site www.isic.fr, which are developed by the company "Global Youth & Student Community" (hereinafter "we" or "the seller").
You declare that you have read and accepted the Terms and Conditions as well as the rights and obligations arising from them before validating your order. The validation of your order therefore implies acceptance of the current GTC.
All products and services sold on the Site are governed by these GTC. We object to any general or special conditions that are contrary or derogatory to these conditions. We reserve the right to modify these terms and conditions at any time by publishing a new version on our website. The applicable GTC are those in force at the date of payment of the order. These GTC are available on the Site at the following address: http://isic.fr/page/cgu
The non-observance by a Customer of his obligations under the present GTC could lead to the suspension or even the cancellation of his account, without prejudice to any damages that the company "Global Youth & Student Community" could request.
The websites and smartphone applications, including www.isic.fr and the "ISIC France" application, are published and operated by the company "Global Youth & Student Community", a limited liability company with a capital of 100,000 euros, registered in the PARIS Trade and Companies Register under number 493.503.841, whose head office is located at 9 rue René Goscinny - 75013 Paris, represented by Mr. Lilian Leclercq, Director of Publication. Intracommunity VAT number: FR50493503841.
2-2-Conclusion of the contract online
The Customer will have to follow a series of steps specific to each Product offered by the Seller to be able to carry out his order.
However, the steps described below are systematic:
- Identification by the opening of a customer account carrying one of the cards developed by GYSC with Acceptance of the present General Conditions of Sale
- Information on the essential characteristics of the Product (price, description, methods of delivery...)
- Choice of the Product, if necessary of its options and indication of the essential data of the Customer (necessary identification, e-mail address)
- Verification of the elements of the order and, if necessary, correction of errors
- Follow-up of the payment instructions and payment of the products
- Delivery of products by email or via smartphone applications
- Confirmation by email of the payment of the order and sending of the automatic purchase invoice
- For products delivered by post, this delivery will be made to the address indicated by the Customer. In order to complete the order correctly, and in accordance with Article 1316-1 of the Civil Code, the Customer undertakes to provide truthful identification details.
The Seller reserves the right to refuse the order, for example for any abnormal request, made in bad faith or for any legitimate reason, for the maximum quantities of products that can be purchased.
2-3-Products and services
The essential characteristics of the goods and services and their respective prices are made available to the buyer on the company's websites and smartphone applications. The customer certifies that he/she has received a detail of the delivery costs as well as the terms of payment, delivery and execution of the contract. The Seller undertakes to honor the Customer's order within the limits of available stocks of Products only. In the event of failure to do so, the Vendor shall inform the Customer. This contractual information is presented in detail and in French. In accordance with French law, it is summarized and confirmed during the validation of the order. The parties agree that the illustrations or photos of the products offered for sale have no contractual value. The duration of validity of the offer of the Products as well as their prices is specified on the Company's websites, as well as the minimum duration of the proposed contracts when they concern a continuous or periodic supply of products or services. Except under special conditions, the rights granted hereunder are granted solely to the natural person who signs the order or the person who holds the email address communicated.
In accordance with the legal provisions concerning conformity and hidden defects, the Seller shall refund or exchange defective products or products that do not correspond to the order. The refund or exchange can be requested by email to firstname.lastname@example.org
2-4-Property reserve clause
The products remain the property of the Company until full payment of the price.
2-5-Prices and delivery
The prices of the products sold on the websites and smartphone applications are indicated in Euros, all taxes included.
In the case of a purchase of an ISIC, IYTC and ITIC card, the Customer will be offered 2 types of cards:
- A digital card that can be downloaded on the GYSC applications
- A physical and digital card sent by post to the address indicated
At the end of the ordering process, a payment by bank card is proposed.
Any payment will be considered as final only after effective and complete collection of the sums by us. We do not take in charge the expenses related to payments coming from countries outside France.
2-6-Methods of delivery
The products are delivered to the delivery address that was indicated at the time of the order and the time indicated. This period does not consider the preparation time of the order.
When the Customer orders several products at the same time, these may have different delivery times, which are routed for the duration of preparation of the order the longest. In case of delay of shipment exceeding 3 working days or in case of delay of delivery, the Customer has the possibility to cancel the contract in the conditions and modalities defined in the Article L 138-2 of the Code of the consumption. The Seller shall then proceed to reimburse the product and the "outbound" costs in accordance with Article L 138-3 of the French Consumer Code. The Seller provides a point of contact by email (email@example.com) indicated in the order confirmation email in order to follow up the order. The Seller reminds that when the Customer takes physical possession of the products, the risks of loss or damage of the products are transferred to him. It is the Customer's responsibility to notify the carrier of any reservations about the product delivered.
2-7-Availability and presentation
Orders will be processed within the limits of our available stocks or subject to the stocks available from our suppliers. In case of unavailability of an article for a period exceeding 3 working days, you will be immediately warned of the foreseeable delays of delivery and the order of this article could be cancelled on simple request. The customer will then be able to request a refund for the article, without any other costs.
2-8-Legal warranty and customer service
In case of defects or non-conformity of the received goods, you benefit from the legal guarantees provided by the legislation in force.
For any question or complaint, do not hesitate to contact us by e-mail at firstname.lastname@example.org. We will examine your request as soon as possible and will contact you after receiving the documents and/or your request or complaint. You can facilitate the processing of your complaint by describing the problem as accurately as possible, and by sending us a copy of the invoice or by indicating the references of the order (the order number, customer reference, etc.).
Payment is due immediately upon ordering, including for pre-ordered products. The Customer can pay by secure bank card.
Cards issued by banks domiciled outside France must be international bank cards (Mastercard, Visa, American Express). The information transmitted is encrypted according to the rules of the art and cannot be read during transport.
Once the payment is initiated by the Customer, the transaction is immediately debited after verification of the information. In accordance with Article L. 132-2 of the French Monetary and Financial Code, the commitment to pay by card is irrevocable. By communicating his banking information at the time of the sale, the Customer authorizes the Seller to debit his card for the amount relating to the price indicated. The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or the impossibility of debiting the card, the Sale shall be immediately cancelled by operation of law and the order cancelled.
In accordance with Article L. 121-20 of the Consumer Code, "the consumer has a period of fourteen clear days to exercise his right of withdrawal without having to justify his reasons or pay penalties, except, where appropriate, the cost of return". "The period mentioned in the previous paragraph runs from the date of receipt for goods or acceptance of the offer for services. The right of withdrawal can be exercised by contacting the Company by email, stating that you wish to use your right of withdrawal.
We inform Customers that in accordance with Article L. 121-20-2 of the Consumer Code, this right of withdrawal cannot be exercised for all products benefiting from an immediate issue and delivery by sending an "e-ticket" in ".PDF" format and can thus be consumed without delay. This includes, for example, all tickets for amusement parks, shows, exhibitions, sports and cultural events, gift cards, tickets for cultural and leisure visits, insurance, ISIC, IYTC and ITIC cards, etc.
In case of exercise of the right of withdrawal within the above-mentioned period, only the price of the product(s) purchased and the shipping costs will be reimbursed, the return costs remain the responsibility of the Customer. The products must be returned in their original condition and complete (packaging, accessories, instructions...) so that they can be marketed again in new condition; if possible, they must be accompanied by a copy of the proof of purchase. In accordance with the legal provisions, the Customer must first send his request for the right of withdrawal by email to email@example.com. Our customer service will then take care of the file. The returns of products authorized by the Site will have to be done at the following address GYSC - 9 rue René Goscinny - 75013 Paris.
As of reception of the products and their checking, a refunding without delay is carried out.
In accordance with the law, the Seller assumes two guarantees: of conformity and relative to the hidden defects of the products. The Seller refunds the buyer or exchanges the apparently defective products or not corresponding to the made order. The request for refunding must be carried out by email to firstname.lastname@example.org.
GYSC reminds that the consumer:
- has a 2 year deadline as from the delivery of the good to act near GYSC;
- that he can choose between the replacement and the repair of the good subject to the conditions envisaged by the art;
- that he is exempted to bring the proof of the existence of the defect of conformity of the good during the six months following the delivery of the good.
- that, except for second-hand goods, this period will be extended to 24 months as of March 18, 2016.
- that the consumer may also assert the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and, in this case, he may choose between the resolution of the sale or a reduction of the sale price (provisions of Articles 1644 of the Civil Code).
If necessary, the Buyer can present any complaint by contacting the company by email at email@example.com.
The non-use within the limits of validity of the delivered product does not involve any refunding of GYSC.
2-13-Intellectual property rights
The brands, domain names, products, software, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of the seller. No transfer of intellectual property rights is carried out through the present GTC. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.
The execution of the seller's obligations under the present contract is suspended in case of a fortuitous event or force majeure which would prevent the execution. The seller will notify the customer of the occurrence of such an event as soon as possible.
2-15-Nullity and modification of the contract
If one of the stipulations of the present contract were to be cancelled, this nullity would not entail the nullity of the other stipulations which will remain in force between the parties. Any modification of the contract shall be valid only after a written and signed agreement of the parties.
2-16-Limiting clause of responsibility
It is stipulated that the liability of the Seller for the performance of the service is limited to 500 euros.
All clauses in these general terms and conditions of sale, as well as all purchase and sale operations referred to herein, shall be subject to French law.
